The 21-Day Rule
Your landlord must return your deposit or provide an itemized statement of deductions within 21 calendar days of move-out. Miss the deadline? They forfeit the right to keep anything. (Civil Code §1950.5)
Normal Wear and Tear
Landlords cannot deduct for normal wear and tear — minor scuffs, nail holes, faded paint, worn carpet in high-traffic areas. These are the natural result of living in a home.
2x Penalty
If a court finds your landlord acted in bad faith — intentionally withholding your deposit without justification — you can recover up to twice your deposit amount.
Receipt Requirement
For any deduction over $125, your landlord must provide receipts or invoices. As of 2025, before-and-after photos are also required for repair deductions.
